Task 1.7 Law and Order

LEGAL AND ETHICAL ISSUES


BBFC

My age rating for my short film, will be 15. Therefore i can include:

  • Strong violence (Yes, at 15 violence may be strong. It should not dwell on the infliction of pain or injury, however, and the strongest gory images are unlikely to be acceptable. Strong sadistic violence is also unlikely to be acceptable)
  • Frequent strong language (e.g. 'f***'). (excessive or aggressive use will not be classified as a 15) 
  • Portrayals of sexual activity
  • Strong verbal references to sex (strong detail would be categorised as an 18)
  • Sexual nudity
  • Brief scenes of sexual violence or verbal references to sexual violence
  • Discriminatory language or behaviour
  • Drug taking (At 15 drug taking may be shown but the work as a whole must not promote or encourage drug misuse. The misuse of easily accessible and highly dangerous substances like aerosols or solvents is unlikely to be acceptable at 15.)

What about dangerous behaviour or things teens might copy?- We consider the risk of potential harm to impressionable teenagers. For example, dangerous behaviour such as hanging, suicide and self-harming should not dwell on detail which could be copied. Whether the depiction of easily accessible weapons is acceptable will depend on factors such as realism, context and setting.

What about horror works?- At 15 there can be strong threat and horror as long as there is no sustained focus on sadistic or sexualised threat.

I have chosen '15' to be my age rating, so I can include strong language and disturbing scenes, however it will not be an 18, as it decreases the size of my audience and it will not include extremely bad language or sadistic threats. I will not being making a horror film which contains sadistic or sexualised threats, therefore I am complying with the BBFC's rating of a 15. My film is original but it will not include anything more than any other horror film.

I will be making this film for educational purposes, therefore i will not be making any money. I will list this on bio of the film.


ORIGINALITY

I have watched several horror films over the years, and all of them have inspired me to making my own horror film. I understand that Annabelle is a horror film based on a doll. I am particularly interested in basing my film on a group of china dolls, not only because there aren't many horror films staring dolls, but also because I am petrified of them, and it would be great to direct, film and edit a film which even I am scared of. I have also read many articles based on other peoples experiences with dolls and it makes me really excited to think about bringing china dolls to life in my film. I have thought about the story very much, tweaking bits and adding bits here and there to make it really creepy but also believable. I have made my story very different to any other film that has been made before which definitely makes my story original.

There are lots of things that need to be considered when making a film, such as employment legalisation, health and safety, equal opportunities, employers liability, employee rights, belonging to a trade union, intellectual property,  copyright, trademarks, confidentiality, exclusivity and laws and legalisation. Employment legalisation is a collection of all the laws that prevent employees from discrimination, such as racism, sexism, homophobia and age. This also ensures that employees are working in a safe environment and their personal information is kept safe and confidential. There are several laws and acts which enforce people to abide by the guidelines such as:

  • The Employment Rights Act
  • The Sexual Discrimination Act 1975
  • The Equal Pay Act 1970
  • The Race Relations Act 1976
  • The Disability Discrimination Act 1995
  • The National Minimum Wage Act 1998
  • The Working Time Directive 1999
  • The Employment Reactions Act 1999


These laws are kept in place by the Codes of Practice.

 which are rules that are set by the head of the company you are working for which states how you can act in your workplace. If these rules are not followed then it will not look good on the company and a disciplinary will be in place for the person who has broken those rules. The disciplinary normally consists of warnings being given to employees and once they have had a certain amount of warnings they are fired.
